LAS VEGAS (KLAS) – The Nevada Secretary of State’s Office has concluded Henderson City Councilman Dan Shaw is not in breach of state law, following accusations surrounding his residency.

On Sept. 30, the state office submitted a response to the councilman’s campaign amid accusations of a breach of Nevada election statutes, largely looking into whether Shaw was truthful about his Henderson residency on his declaration of candidacy.

“Our investigation found no evidence that shows your client violated NRS 293,” state staff wrote. “As a result, no further action will be taken by this office and the file will be closed.”

8 News Now requested a reaction from the Shaw campaign regarding the state’s findings and what it means moving forward.

“We are pleased, but not surprised regarding the Secretary of State’s findings on Councilman Dan Shaw’s residency challenge,” Shaw’s campaign staff wrote. “As many voters already know he has been a Nevada resident for over 40 years and has demonstrated a history of service to our community in a variety of roles during that time.”

Shaw’s campaign alleged the investigation, initially spurred by a complaint from Former Clark County Commissioner Chris Giunchigliani, was bolstered by Shaw’s opponent for Ward 3, Monica Larson.

“It is unfortunate his opponent chose to run her campaign on this false statement, and a little serendipitous as she has lived here less than two years,” Shaw’s campaign staff wrote. “This should put to bed this unfounded fallacy once and for all.”

Larson’s campaign responded to an 8 News Now request for comment regarding the state investigation and questioned the abilities of the state office.

“With all due respect, it is well known that the Secretary of State does not have the resources to conduct a thorough investigation,” wrote Lisa Mayo-DeRiso, a representative for the Larson campaign. “They are limited to the documents that Dan Shaw filed with them.”

The Larson campaign suggested the possibility of another investigation underway against Shaw but did not provide any evidence of an inquiry by the time of this story’s publication.

“It is our understanding that a more in-depth investigation is still underway by another agency,” Mayo-DeRiso wrote. “Therefore, the verdict is still pending as to Dan Shaw’s full-time legal domicile.”
