LAS VEGAS (KLAS) — A man was arrested nearly two years after a deadly suspected DUI crash in Pahrump, according to Nevada State police.
Nevada State Police Highway Patrol’s Traffic Homicide Unit arrested Damian Berry, 41, of Pahrump on Aug. 8 on a charge of vehicular homicide.
On Sept. 11, the Nye County Sheriff’s office responded to a roll-over crash involving a 1993 Chevrolet Classic near Bourbon Street and Hall Avenue in Pahrump.
Both occupants of the vehicle were unrestrained and medical personnel pronounced one of the occupants, identified as Michael Kilgore, 53, dead at the scene. The other occupant, Berry, was taken to a local hospital.
At the hospital, Berry showed signs of impairment and admitted to drinking. Police said Berry had a BAC of .14 and had marijuana in his system when he arrived at the hospital, police said.
Due to limited information at the time of the crash, investigators relied on DNA forensics to identify who was driving and who was the passenger. Through “extensive investigation efforts,” police were able to confirm that Berry was the driver of the Chevrolet, NSP said.
An arrest warrant was issued for Berry on July 20 and on Aug. 8 he was arrested in Las Vegas. On Aug. 15 was taken to the Nye County Detention Center where he remains in custody with a $500,000 bail.
